Privacy policy

By completing the order form, completing the contact form and registering, you provide the operator of the e-shop, Crocodille ČR, spol. s. r. o., Identification No.: 43001343, with its registered office at Poděbradská 206/57, 198 00 Prague 9 (hereinafter referred to as the “Controller” or “Controller of Personal Data”), with the possibility to use your personal data. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (General Data Protection Regulation, or GDPR), this page has the purpose of providing information about the kind of information that we collect with regard to you in connection with the provision of accommodation services and about the reasons that we use your information and the manner of such use, as well as about your rights with respect to the personal data that we use and the manner in which you can exercise those rights in accordance with the GDPR. 
 
INFORMATION ABOUT YOU THAT WE COLLECT AND HOW WE USE IT 
In connection with a purchase, we process data in the scope provided when filling out the order form (primarily your name, contact details, delivery address and your billing information). We need such data primarily for the purpose of ensuring performance of the agreement on the basis of which we will deliver the ordered food products to you using the method that you have selected. For the purposes of performance of the agreement, we will process your personal data only for the period necessary for the fulfilment of our obligations.  
We use your personal data also for the purpose of providing transport (performance of our part of the agreement). We hand such data over to transport companies. Due to the possibility of complaints both on the part of the customer and on the part of the transport company, we will retain your personal data for a period of five years from the date of order creation.  
We will also use the contact details that you provide for record-keeping purposes and for sending you additional information and commercial messages. It is in our legitimate interest to maintain our customer database, just as it is in our legitimate interest to have the possibility to address you with our well-intentioned commercial offers. We need records of our customers particularly for the purpose of protecting our rights and in the event that a legal dispute arises.  For marketing and record-keeping purposes, we will process your personal data for a period of five years from the date of your last order. However, you needn’t be concerned that we will bother you by sending you commercial messages. In fact, you will find in each such message sent to you that not only is it a commercial message, but that it also contains a link via which you can unsubscribe and we will thus no longer send you commercial messages. 
We will use the personal data that you provide to us in the contact form (your name and e-mail address) for handling any given message that you send. After handling such message, we will delete such personal data without undue delay.  
In the event that we create any accounting document containing your personal data, we have the legal obligation to archive such document for a period of ten years.  
We may entrust the processing of your personal data to a third party, i.e. a processor. With the exception of transport companies, direct suppliers, entities within the Crocodille group and franchisees of the 360pizza concept, your personal data will not be transferred to third parties without your prior consent. At the same time, we would like to assure you that we will not transfer your personal data to any country outside of the EU.  
 

RIGHTS GRANTED TO YOU BY THE GDPR AND HOW TO EXERCISE THEM IN RELATION TO US 

 
THE RIGHT OF ACCESS TO INFORMATION AND THE RIGHT TO CORRECTION OF INFORMATION 
At any time you want in the future, you can request, by sending a message to the e-mail address info@360pizza.com, that we send you confirmation of whether or not we are processing your personal data. In the event that your data is being processed by us, we may, at your request, also inform you about any third parties to whom your personal data has been or will be made accessible, beyond the scope of the information provided in the General Terms and Conditions, this Privacy Policy and the document containing information on the use of cookies. If we do not obtain personal information from you, you have the right to all information available to us regarding where we obtained your personal information. 
If we inaccurately process your personal data, you can notify us of such fact by sending a message to the e-mail address info@360pizza.com, and we will subsequently correct the inaccurate personal data without undue delay. By sending a written request to our customer department, it is possible to request the deletion of your user account and the personal data that is not necessary for further processing.  
 
THE RIGHT TO RAISE OBJECTIONS AGAINST PERSONAL DATA PROCESSING 
In cases when we process your personal data on the basis of our legitimate interest, you have the right to raise objections against such processing by sending a message to the e-mail address info@360pizza.com. If you file such an objection, we will not be able to process your personal data until we demonstrate the serious legitimate reason we have for processing and that our reason outweighs your interests, rights and freedoms or the exercise or defence of legal claims.  
If you file an objection against the processing of your personal data for the purposes of direct marketing (e.g. for the purpose of sending commercial messages), we will no longer process your data for the purposes of direct marketing.  
 
THE RIGHT TO RESTRICTION OF WORKING WITH PERSONAL DATA 
You have the right to request that we restrict any processing of your personal data, including the deletion of such data, i.e. that we cease handling your data:  
If you inform us that the data that we have collected is inaccurate, we shall cease processing until the data’s accuracy has been verified.  
If the processing of your personal data is illegal and, instead of deletion, you request the restriction of such data’s use by sending a message to the e-mail address info@360pizza.com
If we no longer need your personal data for the provision of our services, but you need the data for the purpose of exercising your rights.  
If, in accordance with the above paragraph, you raise an objection against processing, in which case we will restrict processing until we have verified that our reasons outweigh your interests.  
 

THE RIGHT TO BE FORGOTTEN (RIGHT TO DELETION OF PERSONAL DATA) 

 
IN THE EVENT THAT YOU DETERMINE THAT WE ARE PROCESSING YOUR PERSONAL DATA:  
Even though the processing of such data is no longer necessary for the purposes for which we obtained the data, if you raise an objection in accordance with the above paragraph and we are unable to demonstrate to you legitimate reasons for processing the data that outweigh your interests, rights and freedoms or the exercise or defence of legal claims, and/or we are illegitimately processing your personal data, you have the right to request that we delete your personal data processed in this manner without undue delay after you have notified us of such facts by sending a message to the e-mail address info@360.com. However, we cannot delete the data even at your request if the data processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of any of our legal obligations or for the performance of a task carried out in the public interest, or for the establishment, exercise or defence of our legal claims. 
 
THE RIGHT TO PROVISION OF DATA IN A MACHINE-READABLE FORMAT 
If, by sending a message to the e-mail address info@360pizza.com, you request that we provide you with your personal data that we process, we will send it to you in a structured, commonly used and machine-readable format (e.g. in *.xls, *.csv or similar format). If you request that we send your personal data to another data controller, we will of course comply with your request. 
 
THE RIGHT TO FILE A COMPLAINT WITH THE OFFICE FOR PERSONAL DATA PROTECTION 
In the event that you are of the opinion that we are not fulfilling all of our legal obligations arising in connection with the processing of your personal data, please first contact us directly. If our colleagues are unable to assist you, you of course have the right to contact the Office for Personal Data Protection, either at the physical address of the office at Pplk. Sochora 27, Prague 7, Postal code 170 00, by e-mail at posta@uoou.cz, or by any other means accepted by the Office for Personal Data Protection.
